Terms & Conditions:- 1. The Card (a) Use of your Otterycard (hereafter referred to as “the Card”), shall constitute your acceptance of these Terms & Conditions. (b) Ottery St Mary Chamber of Commerce (“the Chamber”) reserves the right to vary these Terms & Conditions or to substitute or withdraw the Otterycard scheme (“the Scheme”) by writing to customers (by letter or email) and/or by giving notice which will be displayed on the Chamber website www.otterycommerce.co.uk (c) Use of your Card or any Card issued under a Scheme replacing this Scheme shall constitute your acceptance of the varied and/or new Terms & Conditions. (d) Your Card is not a credit, debit or cheque guarantee card, and cannot be used as such. (e) Cards are not transferable. They must be signed on the back by the Cardholder and used only by the person who has signed them. 2. Applying for the Card (a) The Scheme is open only to UK residents aged 16 and over. (b) In order to become a member of the Scheme, it is necessary that you submit a fully completed Application Form to the Chamber. (c) The Chamber reserves the right to refuse any application or register a Card at its sole discretion. (d) Once accepted, you will receive an Otterycard with a unique number on it. Please sign the Card and make a note of the number for your future reference. (e) If at any time your contact details change, it is your responsibility to advise the Chamber in order that we can update our records. 3. Promotions (a) You must present your Card at the time of purchase to qualify for any Promotions (b) All promotions are at the sole discretion of the Scheme and may be time/availability restricted. (c) If the Promotion specifies a required spend (e.g. Free Gift when you spend £50) you must spend the required amount in a single transaction to qualify for the Special Offer. (d) The Chamber may set a limit on the number of times each cardholder can apply for a Promotion. (e) Additional Terms & Conditions to those contained herein may apply to be advised at the participating outlet. 4. Issuer’s Rights (a) The Card is issued by and remains the property of the Chamber. (b) The Chamber reserves the right to withdraw the Card at any time or refuse to renew or replace the Card. (c) Reasons for withdrawal or non-replacement of Cards may include (but are not restricted to) – any abuse or attempted abuse of the Scheme; any use or attempted use of a Card in a manner which is contrary to the Terms & Conditions; any reasonable suspicion of dishonesty on the part of the Cardholder, in connection with the Scheme; any reason that the Cardholder has been barred from Otterycard. (d) You must surrender the Card to the Chamber upon request. (e) If you have not used your card for at least 12 months, the Chamber reserves the right to cancel the Card. 5. Cancelling a Card or Reporting it Lost or Stolen (a) Cardholders are responsible for the safekeeping of their own Cards. (b) The Chamber accepts no liability for the loss of Cards. (c) If your Card is lost or stolen, please contact Otterycard via the website. There may be a charge for a replacement card. (d) You may cancel your Card at any time. Please return it to any participating outlet. 6. Data Protection (a) Personal data supplied by an applicant or a Cardholder may be held and processed by computer or otherwise by the Chamber to operate the Cardholder’s account; to confirm, update and enhance Otterycard’s customer records; for statistical analysis; and to establish any Cardholder’s identity. (b) In each case, the processing may continue after the Agreement has ended. (c) Where a Cardholder has provided an email address, the Cardholder may receive marketing messages from Otterycard by email. Any email messages will contain a link to unsubscribe from future emails. (d) The Chamber may use information about any applicant or Cardholder to send the applicant or Cardholder information about other goods, services and/or promotions offered by Otterycard, which the Chamber believes may be of interest to the applicant or Cardholder. (e) Otterycard may contact Cardholders using any of the contact details provided on the Application Form. (f) The Chamber will not give your contact information to any third parties except to any agent or sub-contractor of Otterycard; to any person to whom the Chamber proposes to transfer any of its rights and/or duties under this Agreement; to any organisation that endorses the Card. 7. General (a) These Terms & Conditions shall be governed by English Law and you submit to the exclusive jurisdiction of the English courts to settle any dispute arising out of or in connection with them, the Card or the Scheme. (b) The promoter of the Scheme is Ottery St Mary Chamber of Commerce.

2. Minutes of last meeting were approved by those present.
3. Ros gave membership updated stating most had now paid the yearly subscription, But she was still chasing a few and would appreciate their prompt payment now.
4. The Marketing Committee gave their plans to introduce a loyalty card for our town To encourage shoppers to support our shops more. It was suggested the card would Be free to customers who would only have to fill in a basic form for one; participating members would then have a monthly special offer or discount or service which could only be obtained on showing their card to the business. The monthly offers would be well advertised in the Gazette, on our web-site and in shops. There would be a fee for members taking part to help cover the costs and advertising. The Chamber would however allow some funds towards this as it has a lot of potential and Apart from the card benefits we could gain substantial advertising of the town from it. The Marketing Meeting will meet again and finalise their proposals.

5. Christmas Lights and Late Night Shopping - the Institute had been booked, various people have been approached to participate and Torbay Lighting had been in contact regarding this year’s lights. As previously stated the event will be on Friday 28th November. It was suggested the church bells ringing on the night would be nice, and that a competition should be run on ‘WHY I LIKE LIVING IN OTTERY’ the winner to help switch on the lights.
6. Our Fund Raising Committee had reported two successful car boot sales at the Football Club with a further one planned for Sunday 12th October - our thanks to them this will help with our Christmas lights etc.
7. It was reported that at long last thanks to a lot of pressure by this Chamber the minimum spend in the Hine Street Car Park is now 30 pence which will buy 20 minutes time. We are looking to inform customers with the help of the Sidmouth Herald and the Ottery Gazette.

8. General parking in town was discussed with suggestions being submitted to approach the Council to remove the double yellow lines by Otter Gems and remove the now unused taxi rank from there to free up more valuable parking spaces for our customers.
9. Some members had expressed the view they would like better policing in the town as vehicles were getting damaged and some properties. The police have stated that every crime should be reported to them however small as that is the only way to combat it and the more complaints made the greater the police presence will be.
There being no other business the meeting closed at 8.45p.m. the next meeting of the Chamber will be on THURSDAY 2nd OCTOBER 2008 AT 7 P.M. FOR START AT 7.30 P.M. at the TUMBLING WEIR HOTEL it is hoped more members will make an effort to attend this.

The chamber's website has now been redesigned to allow easy non-technical updating without the need to employ a web designer using the specially designed content management system. This means that the website should now be updated much more frequently and without incurring any more cost as it can be edited via a form interface by users within the chamber. This work was completed by Simon Wilkinson (simon@digitalfunktion.co.uk) and will hopefully eliminate any out-of-date information from the site.
